MABS, Borough file petitions to intervene in sale case
SHENANDOAH – Shenandoah Borough and the Municipal Authority it is planning to sell have filed petitions to intervene in support of its pending case before the Pennsylvania Public Utilities Commission (PUC).
In Nov. 2020, the borough approved selling the Municipal Authority of the Borough of Shenandoah (MABS) to Aqua Pennsylvania, one of the largest private water companies in the nation, for $12 Million, following two public hearings. Shenandoah would receive around half the sale price, after paying off MABS debt.
In PUC filings Friday, both the Borough and MABS filed petitions to intervene in the case in support of the sale.
The documents, filed by William C. Rhodes from the Ballard Spahr law firm of Philadelphia, say both intend “to play an active role in the Commission’s decision-making process and its participation herein will not unduly prejudice any party.”
“Shenandoah has a substantial and bona fide interest in the subject matter of this docket and its interests cannot be represented or protected adequately by other existing parties to this docket,” the borough’s filing states. “Additionally, as a party to the [asset purchase agreement], Shenandoah submits that its intervention is in the public interest.”
The filings state that Aqua’s application before the PUC relies on both entities’ “consent to the sale of [MABS].”
