East Union to appeal zoning decision affirming original zoning permit for truck shop

SHEPPTON – East Union Township is planning to appeal a zoning board decision that affirmed a zoning permit issued two years ago.

The zoning hearing board heard an appeal from Bob Lex, LLC last month regarding a planned truck shop on Route 924 in Sheppton.

A zoning permit had been issued two years ago for the shop and, when it was up for renewal, representatives for Lex said the permit was rescinded because it had been issued “in error.”

At the hearing, the township claimed Lex had lied about the use of the property because he had planned to rent the property out for truck repair, sales, and auto detailing. The township claimed that was materially different than Lex using the property himself for the same, as he requested permission for.

After a lengthy hearing, the zoning board voted 4-0 to allow Lex to use the property for the truck shop.

At Monday’s regular township supervisors meeting, Vice Chair Wendy Danchision raised a motion to appeal the zoning board’s decision.

“At the hearing, all zoning members were unanimous,” Supervisor Jill Careyva said.

“As Attorney [Donald] Karpowich said, we’re a party to the hearing, we have a right to appeal it,” Chair Kyle Mummey said.

Mummey seconded the motion, which passed 2-1 with Careyva dissenting.

In other business, supervisors discussed technology upgrades, including the rollout of new emails.

They also thanked North Union Township for their help with installing Christmas decorations in the villages of Brandonville, Sheppton, and Oneida.

Supervisors also voted to provide an extension for the land development plan for the Phinneyville solar farm to allow for necessary agreements to be drafted and ratified.
