Borough approves settlement of Right-To-Know lawsuit

SHENANDOAH – Borough Council approved a $1,500 payment to settle a lawsuit brought by a New York firm over alleged Right-To-Know law violations.

Jamestown Trust, of 2025 Flanders Road, Flanders, NY, which owns a former furniture warehouse on North Ferguson Street, filed a lawsuit against Shenandoah borough in November of 2022.

Solicitor James Amato said the suit was brought for allegations of non-responsiveness and “failure to provide sufficient documents under Right-To-Know requests.

“Several of which were duplicative, several of which were, in our opinion, not appropriate, and many of which we responded to,” Amato said. “They brought litigation saying we violated the right-to-know law and pursued litigation demanding upwards of $8,000 to $10,000 for the alleged violations.”

Amato said at a hearing, it was determined $1,500 was an appropriate resolution and would avoid further litigation and attorney’s fees.

He said the settlement is not an admission of wrong-doing on the borough’s part.

According to the Office of Open Records website, there is no issued decision regarding an appeal by Jamestown Trust.
